These General Terms and Conditions of The PatchFactory, Holmfors 4, 914 94 Nyåker, Sweden ( Owner: Andree Mike Koriath ), are valid for and about all contracts concluded on this platform ( Internet shop: https://the-patchfactory.com ), as well as on the sales platform Etsy. We expressly exclude the seller's terms and conditions, if any, unless they are approved separately and in writing and recorded in advance and signed by both parties.

Consumer and or buyer, in the sense of these terms and conditions, is any natural person who is fully capable of doing business before the law. Legal persons in the sense of associations or companies always have a natural contact person.

All articles offered in the online shop (https//the-patchfactory.com) are the property of Andree Mike Koriath (name of the shop: The PatchFactory). This applies in particular to motifs, as well as motifs in words and pictures and motifs consisting only of words. All our motifs, as well as motifs in Word and image and motifs consisting only of Word, have a time stamp in the manufacturer / raw file, so that it can be determined exactly when this motif was created.

In the case of customised fabrications, the right of use is transferred to the customer, but the product/motif itself, if designed by The PatchFactory, remains the property of The PatchFactory (Andree Mike Koriath).

In the case of motifs which have been sent to us for cutting / plotting or reproduction, the right of use remains with the client / customer. The customer alone is responsible for any legal claims that may arise.

We strictly reject fabrications of trademarked articles or trademarked products until a certified release for processing the motif has been submitted by the owner or his authorised person. This must be submitted to us by the client and must be issued by the owner of the trade mark rights. We reserve the right to check this release and to refuse the order if necessary in the event of any ambiguities.

The PatchFactory assumes no liability and / or responsibility if our motifs, above mentioned in word and image combined, or as custom-made, are misused and this then leads to confusion and / or equalisation of well-known brands.

In the case of the download articles mentioned, the customer acquires the right to cut the motif contained in the file as a packed file, called a "ZIP" file, himself as a private person. Commercial distribution of the motif(s) is prohibited, whether as a file, file in modified form or as a produced cut.

The customer can put together all items in the online shop individually and order them in any of the colours offered and in the quantity of his choice. Some articles can/must be further or extra individualised, for which you will be asked to provide further details in the corresponding article.

All articles available at The PatchFactory Online Shop ( https://www.the-patchfactoy.com ) will be individually manufactured by us in colour and, if necessary, further customisable details by the customer after successful completion of the order process. The production time may vary depending on the quantity and/or complexity of the respective order. In the event of longer production times, the customer will be informed accordingly.

VAT will be shown separately on the invoice where applicable. Sales via the online platform Etsy are VAT-free. The buyer is responsible for paying any taxes.

The goods remain the property of The PatchFactory until full payment has been received. We reserve the right to dispatch the goods only after full payment has been made, unless otherwise agreed in advance and this has been recorded in writing for both parties.

The customer / buyer can personalise each item. On the one hand, this can be done for certain articles, with further details, such as names or numbers. For articles where personalisation data is specified, e.g. desired name / desired word, the article is manufactured according to the information in the article. Personalisation can also be agreed separately and also commissioned.

In the case of custom-made products/personalisations, e.g. enlargements or reductions of one of our articles, the customer must contact us in advance. This cannot be adjusted after the order process. We will have to check and, if necessary, test in advance whether the corresponding wishes can be realised at all.

We will discuss customised products, such as logo creation or similar, in writing and by telephone. Pricing will be based on the amount of work and material required.

Cut files, which have been ordered personalised by the customer, are offered to the customer either by e-mail or as a corresponding article in the shop. The production of the article takes place after receipt of payment, after completion the article is either made available to the customer via download in the shop or sent by e-mail as an attachment.

The online shop automatically sends the customer an order confirmation after a successful order process. If you have not received this, please check your spam folder beforehand. Sending / receiving an e-mail can also take a few hours under certain circumstances (24 hours is given as a guideline by some providers). We therefore ask you to wait a maximum of this time or to contact us separately before completing a new order process.

After completion of the order process by the customer, a legally valid purchase contract is concluded. This cannot be revoked by the buyer due to the customisation process.

In the case of articles that provide a download, the customer will be provided with a corresponding link after the purchase contract has been concluded, where the file can be downloaded accordingly.

You can pay in our online shop with PayPal Stripe or Klarna. The payment options vary depending on the country or currency.

Prepayment is only offered by e-mail, our customers are free to choose whether to transfer the outstanding invoice amount manually or via a payment link of their choice. This will be set out in writing in advance.

PayPal is a payment service provider. The terms of use can be found at https://www.paypal.com. For customers with a PayPal account, the terms of use are stored in the respective customer account. In order to process payments with PayPal or via PayPal, you do not necessarily have to have a PayPal account, you can find more information about PayPal ( https://www.paypal.com ).

The goods remain the property of The PatchFactory until full payment has been received.

7)

This shop does not offer shipping. After receiving and paying for the goods, you have the option of downloading the item(s) as a download file in your customer area.

The customer is obliged to check the goods for any faults or defects immediately upon receipt.

Reasons for complaint are not stripes on the goods or creases in the carrier film. Please address all complaints to rekla@the-patchfactory.com. please include your order number in the subject line. Alternatively, you can also use our contact form. Please attach a picture of the complaint so that we can recognise what kind of defect it is.

You will be informed about the complaint within a maximum of 3 working days, whether we need further information or whether you will be sent a replacement immediately.

There is no need to check download items or their files. These files are available to the customer directly after successful completion of the purchase by the payment provider. We assume no liability for the downloaded file, especially with regard to loss or deletion of the file(s).

Vouchers or discount coupons can be entered independently during the checkout process. Subsequent entry by The PatchFactory is not possible.

The PatchFactory does not sell vouchers. A voucher is issued by The PatchFactory and is sent directly to the customer.

The voucher is entered exclusively by the customer. The customer is liable for any loss.

The EU Commission provides a platform for online dispute resolution on the Internet at the following link https://ec.europa.eu/consumers/odr

This platform serves as a contact point for the out-of-court settlement of disputes arising from online purchase or service contracts in which a consumer is involved.

The PatchFactory is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
